The Board of Directors oversees Tennessee’s Captive Insurance Program. The duties of the Board are found in T.C.A. § 9-8-103. The Board of Directors of the State of Tennessee Captive Insurance Company provides general oversight of Tennessee’s Captive Insurance Company.

The Captive Insurance Company was formed in June 2022. The main purpose for creating the Captive Insurance Company was to avoid using traditional commercial insurance companies, which have been extremely volatile in pricing over the past years. Through the Captive Insurance Company, the State expects to reduce its overall costs, have the ability to insure difficult risks, and have direct access to reinsurance markets, which will increase the likelihood of savings in premiums and other costs associated with the purchase of insurance from the traditional insurance market.

The Company only insures the State of Tennessee’s potential losses, exposures and risks of the executive, legislative and judicial branches of the Tennessee state government including, but not limited to, Tennessee public institutions of higher education. Initially, the Captive Insurance Company will provide the cyber liability and all-risk property coverages. All other lines of coverage, such as fine arts, crime, etc., will continue to be purchased using traditional commercial insurance companies.

The purpose of this meeting is for the Advisory Council to hear and consider presentations by officials, analysts and actuaries concerning the current workers’ compensation insurance markets in Tennessee and claims administration data trends in the workers’ compensation system. The meeting will also serve as preparation for a subsequent meeting within 4-6 weeks at which point the Advisory Council will make a recommendation to the Commissioner of the Department of Commerce and Insurance relative to the voluntary market loss cost filing by NCCI, proposed to be effective March 1, 2022.
